PRIVACY POLICY This Privacy Policy is designed to help you understand how KRHFT Studios LLC, a California corporation, and its affiliates (collectively called “KRFHT Studios”, “we,” “us,” and “our”) collects, uses, and shares your personal information and to help you understand and exercise your privacy rights. This Privacy Policy applies to personal information collected and processed by KRHFT Studios LLCs website, which allows for the transacting of NFTs, staking of NFTs and other services as may be offered by KRHFT Studios LLC from time to time (collectively, the “Services”). For clarity, the Services do not include any decentralized aspect of the Ethereum Blockchain that are not controlled by KRHFT Studios LLC due to the decentralized nature of the open blockchain networks. “NFT” in this Privacy Policy means a non-fungible token or similar digital asset implemented on a blockchain (such as the Ethereum blockchain), which uses smart contracts to link to or otherwise be associated with certain content or data. 1. CHANGES TO OUR PRIVACY POLICY We may revise this Privacy Policy from time to time in our sole discretion. If there are any material changes to this Privacy Policy, we will notify you as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Privacy Policy if you continue to use our Services after the new Privacy Policy takes effect. 2. PERSONAL INFORMATION WE COLLECT The categories of personal information we collect depend on how you interact with us, our Services and the requirements of applicable law. We collect information that you provide to us, information we obtain automatically when you use our Services, and information from other sources such as third-party services, as described below. A. Information You Provide to Us Directly We may collect the following personal information that you provide to us. • Ethereum Blockchain and NFT Transfer-related Information. Your wallet, whether or not custodial, desktop, mobile, or “hot” or “cold” (i.e., Metamask, Ledger, Fortmatic, etc.) will serve as account when using our Services. Please note that we do not take possession of your private key. In order to engage in NFT transfers on the Services, you will need to provide us with access to or information about your digital wallet and transfers on the Ethereum Blockchain. As you use the Services, we may collect personal information and details associated with the transfers you are involved with. • Your Communications with Us. We may collect personal information, such as email address, phone number, or mailing address when you request information about our Services, register for any newsletter or marketing promotions we may create, request customer or technical support, apply for a job or otherwise communicate with us. • Interactive Features. We and others who use our Services may collect personal information that you submit or make available through our interactive features. Any personal information you provide on the public sections of these features will be considered “public,” unless otherwise required by applicable law, and is not subject to the privacy protections referenced herein. • Surveys. We may contact you to participate in surveys. If you decide to participate, you may be asked to provide certain information which may include personal information. • Sweepstakes or Contests. We may collect personal information you provide for any sweepstakes or contests that we offer, such as our developer bounties. If you elect to initiate a transaction to purchase or otherwise transfer any NFTs, all such transfer transactions will be conducted solely through the Ethereum Blockchain. Information about your transactions will be provided to the Ethereum Blockchain and may be accessible to third parties due to the public nature of the Ethereum Blockchain. Because entries to the Ethereum Blockchain are, by their nature, public, and because it may be possible for someone to identify you through your pseudonymous, public wallet address using external sources of information, any transaction you enter onto the Ethereum Blockchain could possibly be used to identify you, or information about you. • Third Party Websites and Applications. You may choose to share personal information or interact with third-party websites and/or thirdparty applications, including, but not limited to, third-party electronic wallet extensions. Once your personal information has been shared with a third-party website or a third-party application, it will also be subject to such third partys privacy policy. We encourage you to closely read each third-party website or third-party application privacy policy before sharing your personal information or otherwise interacting with them. Please note that we do not control, and we are not responsible for the third-party websites or the third-party applications processing of your personal information. • Service Providers. SECURITY OF YOUR INFORMATION We take steps designed to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized disclosure. By using our Services or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our Services. SUPPLEMENTAL NOTICE FOR NEVADA RESIDENTS If you are a resident of Nevada, you have the right to opt-out of the sale of certain personal information to third parties who intend to license or sell that personal information. You can exercise this right by contacting us as set forth in “Contact Us” below with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account. Please note that we do not currently sell your personal information as sales are defined in Nevada Revised Statutes Chapter 603A. 11. CHILDRENS INFORMATION The Services are not directed to children under 13 (or other age as required by local law), and we do not knowingly collect personal information from children.
